Employer Sponsored Visas for Australian Businesses

Australian business or overseas business operating in Australia can sponsor overseas skilled workers for a temporary or permanent residence visa depending upon the applicant’s skills, qualifications and work experience and the employer’s location and the position available and business needs.

The most common employer sponsored visa subclasses currently available are:

  • ·Temporary Work (Skilled) Subclass 457 Visa (temporary residency)
  • ·Employer Nomination Scheme (ENS) Subclass 186 (permanent residency)
  • ·Regional Sponsored Migration Scheme (RSMS) Subclass 187(permanent residency)

Recently due to the tightening of occupations available under the 457 Visa and the slower processing times employers are switching focus to the Temporary Work (Short Stay Specialist) Subclass 400 visa.

From March 2018 the Temporary Work (Skilled) Subclass 457 Visa will be replaced by the Temporary Skill Shortage (TSS) Visa.

Employer sponsored visas are ideal for businesses who need to fill a skill shortage which cannot be filled locally. Given the low unemployment rate and steady economic growth many Australian businesses across a wide range of industries are facing a hard time employing suitably qualified and experienced staff to help their businesses grow.

The Temporary Work (Skilled) Subclass 457 Visa can facilitate employment of overseas skilled workers on a temporary basis for either 2 years or 4 years. Your business will need to first become an approved Standard Business Sponsor (SBS) or, depending on the industry in which you operate, to negotiate a Labour Agreement.

Australian business can also recruit an overseas skilled worker for a permanent residency visa through the Employer Nomination Scheme (ENS) or the Regional Sponsored Migration Scheme (RSMS – location dependent). An employer does not need to be an approved SBS to use these programs. However the employer will need to lodge a Nomination Application which in many respects shares similar requirements to becoming an approved SBS. Initially however most employers choose to sponsor under the temporary residency Subclass 457 visa first.

Employer sponsored visas are also ideal for Australian or overseas businesses wanting to set up operations in Australia to recruit overseas skilled workers on a permanent or temporary basis to fill in skill shortages.
